This Notice on the processing of personal data contains information on how Marpro d.o.o. processes your personal data when using and buying through the online store www.gintonic.rs, in accordance with the Law on the Protection of Personal Data ("Official Gazette of RS" No. 87/2018) (" ZZPL ").

1. Who is this Notice on the processing of personal data intended for?

This Notice on the processing of personal data is intended for:

• To persons who use our online store to purchase products and services online (Customers),
• To visitors of the website www.gintonic.rs and to persons who otherwise interact with us.

Your personal data, as the controller, is processed by Marpro d.o.o.  and is responsible for the processing of your personal data.

1. What personal data does the Controller process, on what legal basis and for what purposes?

The operator processes the personal data of the following categories of persons to whom the data refers:

• To persons who use our online store to purchase products and services online (Customers),
• Visitors to the website www.gintonic.rs and persons who otherwise interact with us.

4.1 Persons using our Online Store  to purchase products and services (Customers)

The operator processes the following types of personal data of Persons who use our Online Store to purchase products and services (Customers):

• Identification data, contact data, data on the address and method of delivery and data on the subject of purchase and sale for the purpose of: realization of the purchase, based on the execution of the contract with the buyer (Article 12 paragraph 1 item 2 ZZPL);

• Information about your interaction with us and contact information for the purpose of: (i) providing customer support when using our online store, based on the execution of the contract with the customer (Art. 12 paragraph 1 item 2 ZZPL) and (ii) for the purpose of resolving complaints, based on compliance with legal obligations (Art. 12 paragraph 1 item 3 of the ZZPL, and in connection with article 56 paragraph 6 of the Law on Consumer Protection).

  • for the purpose of sending administrative messages (e.g. notices on changes to the general conditions of use and sale via our online store, changes to notices on the processing of personal data, etc.), and on the basis of contract execution (Art. 12 paragraph 1 item 2 ZZPL);
  • for the purpose of sending commercial messages, including those tailored to your interests, based on your consent (Art. 12 paragraph 1 item 1 ZZPL).

• IP addresses and browser fingerprint (characteristics of the Internet browser and device, operating system, language selection, URL address from which you accessed the Online Store website, location data, data on the pages you visit, access time, frequency and length of visit, links which you access, etc.) for the purpose of (i) preventing abuses, and based on our legitimate interest in the form of maintaining the necessary level of security (Art. 12 paragraph 1 item 6 ZZPL) and for the purpose (ii) improving the user experience, and based on our legitimate interest in the form of improving the functionality of our online store (Article 12 paragraph 1 item 6 ZZPL).

• Data on user credentials: In the event that the customer registers an account through our online store, the seller will use the data on the user account in the form of first name, last name, e-mail address and password for the purpose of registration and easy access, i.e. the realization of the purchase, based on the consent of the user (art. 12 paragraph 1 item 1 ZZPL).

4.2 Website visitors to our Online Store and persons who otherwise interact with us

The controller processes the following types of personal data of visitors to the website of our online store and persons who otherwise interact with us:

• Data on your interaction with us and contact data for the purpose of providing support at your request, based on our legitimate interest in the form of providing support to persons who are not registered (Art. 12 paragraph 1 item 6 of the ZZPL).

The operator of the website of our online store uses cookies. Cookies are small text files that are stored on your device when you visit our website. The handler uses different types for different purposes.

4.3.1. Necessary cookies

These are cookies that enable the basic functioning of the website and as such are necessary for the website itself to function.

4.3.2. Statistical cookies

These cookies allow us to analyze how visitors use our website and to improve the functionality of the website. We process these cookies based on our legitimate interest in improving the functionality of the website, i.e. the online store.

4.3.3 Functionality cookies

These cookies allow us to remember the choices you have made and provide you with a better user experience (e.g. wish list, etc.).

4.3.4. Marketing cookies

We use these cookies to display content and advertisements, including those tailored to your interests. Marketing cookies are also used by other companies with which we cooperate in order to show you advertisements related to products and services that interest you. The use of these cookies requires your prior consent.

1. Legitimate interest

In certain cases, we process your personal data on the basis of legitimate interest (Art. 12 para. 1 item 6 ZZPL). We use this legal basis in situations where the legitimate interest prevails over your interests and basic rights and freedoms. The legitimate interest is reflected in (i) maintaining the necessary level of security of the Online Store, (ii) providing support services to persons who are not our registered customers and (iii) improving the functionality of the Online Store.

1. Do we share your personal data?

The operator shares your personal data with third parties, namely:

1. Courier services, when we deliver via the appropriate courier service;
2. Authorized services, in case of resolving complaints;
3. Facebook, Google, Instagram, TikTok and other providers of the companies we use for the purposes of statistics and targeted advertising through cookies.

In certain cases, we are obliged to share your personal data with authorities. So, for example, we have a legal obligation to present, based on the appropriate judicial or administrative act, all data on the basis of which the detection or prosecution of perpetrators of criminal acts can be undertaken.

1. Do we transfer your personal data to other countries?

The operator transfers your personal data outside the territory of the Republic of Serbia, since the servers on which the data are stored through the Shopify platform are located outside our country, and the transfer also occurs when using Facebook, Google and other tools for analysis and advertising. Keep in mind that in a specific case there is an appropriate level of personal data protection since the companies Facebook, Google and others are signatories to the Privacy Shield.

1. How long do we process your data?

We process your personal data as long as it is necessary to achieve the purpose for which the data is processed, i.e. until consent is revoked (if the processing is based on consent), unless longer data processing is necessary to comply with a legal obligation or to submit, exercise or defend legal requirement.

1. What are your rights regarding personal data?

With regard to the processing of personal data that we carry out, you exercise all the rights prescribed by the ZZPL, namely: the right of access, the right to correction and amendment, the right to delete personal data, the right to limit processing, the right to data portability, the right to object, the right to revoke consent, the right not to apply to a person a decision made solely on the basis of automated processing including profiling.

If you believe that the Controller is processing your personal data contrary to the provisions of the Personal Data Protection Act, you can at any time submit a complaint to the Commissioner for Information of Public Importance and Protection of Personal Data whose contact details are:

Please note that submitting a complaint to the Commissioner does not affect the possibility of protecting your rights by initiating appropriate judicial or administrative proceedings.

 

1. Obligation to provide data

The provision of personal data is a necessary condition for the conclusion and implementation of the sales contract with the Customer. Failure to provide data entails the impossibility of making a purchase through the Online Store, or other rights that you exercise in connection with the purchase. Creating a user account is not a necessary condition for the sale, but the customer will not be able to use the simplified access to our online store.

 

1. Amendments to the Notice on Personal Data Processing

This Notice on the Processing of Personal Data shall enter into force and apply starting from 2024.

Changes and additions to this Notice on the processing of personal data are possible only in writing, of which you will be notified.

On behalf of Marpro d.o.o., we undertake to protect the privacy of all our customers. We collect only necessary, basic data about customers/users and data necessary for business and user information in accordance with good business practices and with the aim of providing quality service. We give customers choices including the ability to decide whether or not they want to be removed from mailing lists used for marketing campaigns. All user/customer data is strictly stored and is available only to employees who need this data to perform their work. All employees of Marpro d.o.o. are responsible for respecting the principles of privacy protection.
